Service Provided “As Is”
Car Servicing Direct Ltd Trading as ar Servicing Direct is dedicated to providing high-quality and reliable automotive servicing. However, our services are offered on an “as is” basis. This means that while we strive for perfection, unforeseen issues or inherent challenges during vehicle servicing may sometimes lead to errors. Examples include, but are not limited to, cases where bolts may become broken, seized, or otherwise compromised due to factors such as hidden wear, existing conditions, or unexpected complications discovered during service.
1. Quality of Service and Inherent Limitations
*Best Efforts.
We commit to using our expertise and best efforts when servicing your vehicle. Despite this commitment, the nature of automotive maintenance sometimes results in parts encountering stress or fatigue, even under normal conditions. As such, occasional faults—including broken or seized bolts—may occur. These issues might be inherent to the vehicle’s existing condition or may emerge during the service process.
“As Is” Service Provision:*
All services are rendered “as is” with all existing faults, and while we take every precaution to minimize errors, you acknowledge that some risks are inherent in the servicing process.
2. Notification and Assessment Process
Reporting Issues:
If you identify any damage or fault—such as the issues mentioned above—that you believe is directly attributable to our service, you must notify us in writing within 7 days of service completion. Your report should include detailed information and, if possible, photographic evidence to assist us in assessing the issue.
Investigation:
Upon receiving your notification, we will promptly conduct a thorough investigation to determine whether the fault (for example, a broken or seized bolt) resulted directly from our service or from pre-existing conditions or inherent vehicle wear.
3. Remediation and Rectification Measures
Taking Responsibility:
In the event that our investigation confirms a fault or damage (such as broken or seized bolts) has occurred as a direct consequence of our service, Car Servicing Direct will:
Make every reasonable effort to rectify the issue through repair or replacement.
Offer compensation or reimbursement if additional costs are incurred due to our error, subject to verification and applicable terms.
Scope of Remediation:
It is important to note that our commitment to remediate applies solely to issues that we have been found responsible for. Faults or damages arising from pre-existing conditions, normal wear and tear, or factors beyond our control (such as parts that were already compromised prior to service) do not fall under this remedial obligation.
4. Limitation of Liability
Extent of Liability:
To the fullest extent permitted by law, Car Servicing Direct’s total liability for any claim regarding service-related faults or damages is limited solely to the cost of the service provided. This limitation applies whether the claim is based in contract, negligence, or otherwise.
Exclusion of Indirect Damages:
Car Servicing Direct shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost opportunities, revenue, or future repair costs.
5. Acceptance of Terms
By engaging our services, you acknowledge and accept that:
Our service is provided “as is,” and while we strive for perfection, some issues inherent to automotive servicing, such as the potential for occasional broken or seized bolts, may arise.
You will notify us promptly if you believe any such issue is directly caused by our service, and you agree to allow a reasonable time period for investigation and remediation.
The limitations of liability outlined above are an integral part of your agreement with Car Servicing Direct.
